The DOE Policy That Protects Pervy Principals Is Finallly Exposed By The Media.
The DOE claims they have a "zero tolerance" policy when a teacher is accused of sexual misconduct against a student. The presumption is that any sexually based allegations against a teacher requires their removal from the school and reassigned to a "rubber room" until their 3020-a termination hearing is scheduled. In fact, any sexually based charges usually results in the teacher receiving a "probable cause" hearing within a month of the DOE substantiating the charges, usually based on merely hearsay evidence and the word of the student. The result is that the teacher is taken off salary and health benefits for up to 90 days and usually results in the teacher's firing if the 3020-a arbitrator upholds the sexual misconduct charges.
By contrast, principals who are accused of sexual misconduct by a teacher or other subordinates will retain their position and any lawsuits brought by the teacher will be fought "tooth and nail" by the DOE in the courts and when the DOE finally loses, the lawsuit, the court case has lasted five or more years. Therefore, by the time the DOE decides to take action against the Principal, they no longer can file 3020-a charges since there is a three year "statue of limitations" between the sexual misconduct and the DOE initiating charges against the Principal. This is done purposely by the DOE since they practice a "double standard" when they assume the Principal is innocent until proven guilty, while teachers who are assumed guilty and removed from the classroom.
The New York Post identified five principals who were accused of sexual misconduct and some of them are still principals while the rest were either demoted to an assistant principal position or reassigned to an administrative office. None of them faced 3020-a charges. Mona Davids President, of the NYC Parents Union said it best
“Clearly the DOE is protecting these principals by running out the clock on the statute of limitations,” Davids said. “They’re not good leaders, and they’re a danger to our kids. If an adult is not safe around that person, what makes you think a child is?”
If the principals were subject to the same DOE rules as teachers, the principals would be reassigned , pending substantiation of the charges and be subject to a 3020-a hearing within the three year statue of limitations. No longer will the DOE's "double standard" protect principals who comment misconduct, sexual or otherwise, by running out the clock and retaining their salary and benefits despite being guilty of the charges.

The first guy, David Jimenez, was totally innocent. He went after Felicia Bray and discontinued her. She decided to go after him and sue him. All of her cases were thrown out of court. She could not get her job back. Finally, the DOE settled to have her go away.

ReplyDeleteFirst off, I never worked in a business with so many gays and lesbians. Although most people are respectful, I was as well as several other "straight" male counterparts sexually harassed by homosexual bosses (either within the school or on a regional level) on a routine basis. Additionally, I witnessed these same individuals in power, inappropriately touch and ogle young male students in the school. As I obviously knew this was wrong, I also was fully aware that bringing such accusations against the DOE would most likely end my teaching career. What makes me irate is that DOE has protected and like the Vatican church protected its sexual deviants and taken vengeance against those who would dare speak the truth. After reading Sunday's NY Daily News article as to how the DOE spent hundreds of thousands of dollars protecting principals who were charged with sexual harassment; but yet somehow managed to keep their $150'000 a year plus job. IAs a result I would not recommend anyone to bring charges or accuse superiors of sexual deviance. If the DOE wants to create an environment that encourages such behavior then so be it....
ReplyDeleteNo, the DOE will continue to protect them, even though this negative news coverage came up. It will be business as usual. We all know it. Just bide your time, keep your head down, pass everyone unless they never showed and get that pension and get out.

ReplyDeleteMy guess is that the DOE officials see themselves and their principals/superintendents on one team and all the teachers and the students on the opposing team.

ReplyDeleteI do not agree with removing anyone because of allegation unless it is an allegation involving students. An AP being u-rated and discontinued then alleging sexual harassment is not enough grounds for removal. Plus, the city settles all lawsuits instead of fighting them. I do not agree with teachers being removed for anything but an allegation with a student. Bray and the other AP Milton were both discontinued and sued later.

My burning question is to the parents. How do you let your child attend schools with principals like these? Like Davids said, what is to stop these pervs from going after students. Many principals do have alone time with students. Do you ever notice also that they can cover their doors all they want? I say shame on the parents for not getting involved. If you really love your kids and care about them, you shouldn't send them to these schools.

ReplyDeleteChaz, what I am saying is if there is an investigation involving a DOE adult engaging inappropriately with a student then I do believe the staff member (whether school aide, principal or teacher) needs to be removed. Having said that if it is a BS corporal punishment or nonsense like that then NO the staff should not be removed. I am more disgusted by pedophiles and think kids should be protected by removing the adult. However, there needs to be proof. I do not think removing staff with BS investigations is the right thing to do.

Not many people are encouraging their kids to go into teaching.
As an ATR who has been to over 50 schools I can tell people this:
ReplyDeleteMost principals - especially from the. leadership academy hide in their office for most of the day
. Never speak directly to staff always use someone else to communicate anything to a staff member
. Have a hard time balancing their budget because most principals are not numbers people so a "budget" is not something they seem comfortable with
. Never seem to look you directly in the eye when you do see or meet with them or even in the hallway - if they are there at all
. Most of them are poor socially. They have social issues for many reasons but most seem to have no social skills
. Are corrupt as can be constantly having closed door meetings - never open about anything
. Treat ATR staff as foreigners - no key for bathroom or a place to put their belongings but most principals treat atr staff this way
. Have issues with anyone trying to implement something new
. Most of these people who are now called "principals" are inferior leaders and this translates into schools that are run like summer camps with kids just moving around and acting like wild creatures.
We can all thank Mr Mikey Bloomberg who created the infamous "principals leadership academy" where anyone can become a principal just drink the poison lemonade they serve you there.

ReplyDeleteLook as someone who has been removed from schools for nonsense - I am against people being removed from schools unless it is an allegation involving relationship/sexual in nature with students. Otherwise, nobody should be removed for unproven allegations. The city decided to u-rate and discontinue some of these females but still pay them money to settle the lawsuit. However, this does not prove the principals were guilty. It proves if you sue the city you can get a settlement.
ReplyDeleteThe first time I was pulled and removed from a school was over rumors that I retired a principal. We had a principal from hell who claimed he was going to retire every year for 4 straight years. He was giving everyone hell. On a day that I was absent from school, I was blamed and eventually removed for placing flyers in every staff member's mailbox inviting them to his surprise retirement party. We even collected money for a gift. We had over 200 people in a bar on the UWS. His superintendent, his colleagues, budget people and even HR people showed up to his surprise retirement party. We had a blast.
Only problem was nobody invited the principal and the principal was not retiring. Even though I knew a great guy whose first name starts with the letter "L" did the invites - it was me who got blamed and removed. I was interrogated hard. They came after me from every angle but I would not tell on "L". I was absent from school that day.

To 8:56, I have worked in only two DOE 'small schools' and I can concur your observations from my much smaller vantage point.

Remember how we retired Mr. B? The whole bar chanting his name and the poor guy never knew he was retiring. I told you someone should have invited him to his retirement party. Did not want to say that "L" was a female in the event people we know were reading this.

On a different note, Bobby got married, Charlie was u-rated and discontinued, Elaine Gorman retired, Alyson ended up at Tweed and Chris ended up at Brandeis. After they closed Brandeis, Chris was never assigned anywhere so he kept reporting there for years. He'd hang out in the basement. A year ago the sup's office was doing a walkthrough and found him in the basement. It was creepy. He had a beard, hadn't shave in months and was talking to himself. He was using a closet as his office. DOE can't even investigate since it was their screw up. Forgot the HR lady in charge of ATRs - Adriane something back then. She was in charge and never assigned him. Poor Chris. Let's find him and see what he is up to.

ReplyDeleteI'm new to this blog and to teaching. I have no experience. I don't even have a degree! My roommate Karen was a ATR for years. Last week she told me she was retiring - kinda. Before she moved to Costa Rica last Friday, she introduced me to her principal and he's letting me take her place. He's totally cool with it. We're splitting her paycheck 70% me, 20% her and 10% to the principal. Karen gets to sit on the beach every day and I get paid 70% of her check to be her for awhile. Looks like you have this shit all figured out. Let me know if you got any tips for me. I'll be checking back for your answer. Doing some more reading and research on here to try and get caught up and prepared for this job. I start on tomorrow 5/23/18.

If you really did congratulations (mazal tov/mubrook/Gōngxǐ/Omedetōgozaimasu) !!! However, last year needed to travel to Africa for 6 weeks and I hired an illegal Chinese guy for 2k. ReplyDeleteKeep your head down. No need to be a hero or to make waves AND do not do what an ATR in the Bronx did last week and try to sell your ATR status on Ebay for 35k. If you do get tired and want to sell it let me know and I can refer you to some dark holes sites.
By the way the investigators told the DOE in Manhattan an ATR could get as much as 100k for their ATR status on the black market.
Be active in the union. Union is the only thing we have. Lastly, do your best to avoid the sick, demented and crazy in the DOE which is about 90 percent of us. Also, join your local ATR Chapter. It is very similar to a bike gang.

The Commissioner of Education could have ordered the Chancellor to file Education Law § 3020-a charges against any or all of these principals, as appropriate.
Furthermore, NYSED’s Office of School Personnel Review and Accountability (OSPRA) could have initiated Part 83 proceedings against any or all of these principals, as appropriate.
The three-year Statute of Limitations doesn’t apply in situations where tenured individuals (whether teachers or administrators) are being charged with having committed a crime.

ReplyDeleteI am in the Chelsea building but not Chelsea H.S. I tried calling you last night. I'd dial 4 or 5 numbers and put the phone down. I even got the courage to dial 7 and 8 numbers. I can't join your Manhattan ATR Chapter (MAC) and I can't go through what we went through last time. We had investigators following us into Macy's and watching us eat. It was too much. Plus, we are only teachers not some CIA operatives. We both never worked for Cohen or Trump. We simply taught. The cheating scandals still continue and the grade fixing never stopped. All this continues at the big level too. I need peace. I can't go through this again. By the way the principal who closed Brandeis was the Baruch principal last year while my principal was out on maternity leave. Brandeis principal excessed me before she left in June. They kept a bilingual younger cuter teacher making 55k. I wasn't surprised. I kind of liked the teacher and we are friends but business is business. Had I known Aaron Schlossberg I would have called him to come and do a rant on bilingual education. Heard he was at 65 Court St. trying to get a substitute license. HA HA.

ReplyDeleteI got up this morning excited to make a difference in the lives of kids. I got to the school at 7am and went straight to the principal's office to get my assignment for the day. When I walked into his office he was making out with a picture that I swear looks just like Karen's instagram profile photo. It was weird. His pants were around his ankles and everything and he was moaning the name Carmen! I ran out of his office and he gave chase down the hallway with his pants still around his ankles screaming "It's not what it looks like!!!!!!!!!" Any way, I waited for him in the main office but he never showed. Instead, he sent his secretary to tell me to report to room 202. When I got there the class was going crazy. There were probably 60 kids in the room.
I told the security guard that escorted me to the room I wasn't going in, but he opened the door and pushed me in. When I opened the door again to try and escape, one kid pulled me back inside by my hair and the rest of the kids started beating the crap out of me. One girl stood over me with her phone pointed at me and she was yelling "WORLDSTAR!" over and over again. What does that even mean? After 20 minutes of this, I felt my soul leave my body and I was watching them continuing to beat the crap out of me from above the classroom. Basically, I'm telling you that I died at 8:30 this morning. I guess I won't be able to fill in for Karen anymore. But, I want to talk to you about selling the ATR position like you offered. I'm willing to accept 100k. But I'm only accepting it in bitcoin. Let me know if ur interested. I'm negotiable, but I know 100k is a good deal, so don't try to low ball me. I'm dead, but I'm not stupid.
