The Lazy DOE Spins The Wheel Of Misfortune When It Comes To Assigning Reassigned Teachers And Then Blames The Teachers Union For The Many Grievances



















The DOE’s arrogance and incompetence is just unbelievable. When the DOE and UFT completed the “rubber room agreement” , the understanding was that many of the reassigned teachers would be placed in their schools in their District and do circular six duties. While, those teachers who were determined to be a “threat to the children” (what a joke. See my Ebony and Ivory post) was to be sent to their CFN’s or the Regional Office. However few, if any, teachers were sent to schools and the nincompoops at the DOE did not have the intelligence to even follow this simple directive from the “rubber room agreement”. Instead, these lazy DOE employees appeared to have spun a wheel to determine the placement of many of the reassigned teachers. This haphazard and ill-conceived distribution of reassigned teachers seems to violate the spirit of the “rubber room agreement” (what else is new?) and the UFT/DOE contract. The DOE’s inept handling of the reassignment problem has resulted in numerous grievances by the reassigned teachers due to the apparent violation of the contract that requires the DOE to place the teachers in their district or Region

In some of the more egregious cases teachers from Staten Island and the Bronx must go to the School Construction Authority in Queens for their duties to measure school buildings. Moreover, Brooklyn teachers were sent to Queens while Queens teachers were sent to Brooklyn. I also wrote previously that it appeared that the reassigned teacher’s location was based upon the first letter of their last name. I guess they spun the wheel and whatever the first letter of the last name came up, that is where that person was sent.

The question is what will our union do about it? Based upon Michael Mulgrew published comments it would seem the union will not take the lead in forcing the DOE to abide by the “rubber room agreement” and the contract but will accept individual grievances for reassigned teachers who are unhappy with either their work assignments or geographic location. Here again the union fails to be pro-active and require the DOE to follow the rules. Instead they leave it up to the reassigned teacher to fight the DOE’s abuse and disregard of the “rubber room agreement”. As for the criticism that the DOE has received from their incompetent handling of the reassigned teacher placement, Tweed has went into a defensive shell and blamed the teachers union New York Post and the Daily News for the many grievances. Our union should have taken the lead on this issue and make sure that the DOE followed the rules. If that means filling a lawsuit, so be it. For many of us it seems that the union once again signs an agreement with the DOE only to take no action when the DOE breaks that agreement.

How many times has the UFT negotiated an agreement with the DOE only to watch the DOE break the agreement or deliberately misinterprets the conditions in the agreement. When it comes to the DOE/UFT agreements, the more things change, the more they stay the same.

Suprise suprise. You didn't really expect the union to do anything at all.

If you contemplate the horrible reality of this situation, you would understand that the union is no more than the hr enforcement arm of the doe.


Go ahead and file the grievances.
A year from now it will get knocked down by some "impartial" arbitrator.

In the meantime it helps to be aware that the union put the teachers in this position to begin with.

Using the color of law to discriminate against senior teachers is what the union signed off on.

Otherwise they would have sued the city when the numbers of inmates in the latex latrine mushroomed exponentially.

Instead, the union saw fit to do a pr spin by hiring Bestsy Combier. She may have helped, but she is not the solution to the destruction of countless careers and lives.

This insult to the intelligence was defined as mandatory.
Many veteran rubber roomers were there. Most have been in this position since they received their
"award".

I guess newbies cannot make any mistakes in the surreal world of the DoE/UFT youth worship culture.
Only those old and experienced "bad" teachers were at the bullshit fair.
The experience was degrading and abusive.
They had special security there. The types in suits and some nondescript pin on the lapel jacket.
The Gestapo of the DoE. I guess they feared that one of the bad old teachers would recognize one of their persicutors and would act violently.
Of course, nothing like that would happen with the most compliant profession on the face of the earth.
Security was composed of the types that appear on video at the pep meetings.
It was a show of force that was laughable. I'm sure that some of the rubber roomers recognized them, because, they would also visit the rubber rooms.
There was also a form of aparthied at the fair. Food and drink were only for the interviewers not the interviewees.
One clever teacher found a badge that said interviewer and went beyond the roped off section and helped himself.
Now that kind of behaviour would get someone sent to the rubber room. Good for those that took from the roped off "white" part of town.
This humilliation will continue untill the bald pimp and the membership sell out the ATR pool. What they don't understand, is that, they will become the next group of ATR's.
It appears crystal clear that the ex rubber roomers, the atr's and those who now are doing scut work that is violation of both the rubber room agreement and that lousy contract need to join forces and sue both the union and the DoE.
The union needs suing for theft of services, misrepresentation and denial of constitutional and contractual rights.
The DoE needs to be sued for malicious prosecution, property rights, and a nice eeoc suit for discrimination based on age.
Come to think of it, the age thing applies equally to the uft. Also. the collusion between both parties should lead to criminal rico action against both entities.
This is a beautiful class action suit. If the teachers mentioned, joined forces they could finance it.
The bad p.r. for both parties might lead to a swift financial solution. Now that would be just desserts.

The rubber room agreement is bad, but worse is the 3020-a process. Cases are moving-really moving. Lawyers are overworked and do not have the time to meet with us. What is going on? Now is the time to use private attorneys who can aggressively stick it to the Board. Rather, than complain about our assignments (and I am using a tape measure), we really need to focus on winning our 3020-a. I am also starting to believe that is not possible. Exactly, how many teachers were totally acquitted in the last 2 years? Exactly how many got fines less than 10,000 dollars and what percentage have be fired? Don't we deserve to have this information? Shouldn't our union voluntarily give it to us? What is going on here?

Why in your post did you crticze young newbies like me. We are not even aloud to go to Job Fairs and with a hiring freeze very few new teachers have been hired. I understand there is an ATR issue but after waiting almost 2 school years for position its get annoying. I would love to go to a job fair I could but DOE does not want new teachers until the ATR problem is fixed they claim and schools want new teachers ATRs claim. What is the truth and will someone like me get a job teaching before 2013 when Bloomberg hopefully finally leaves office?

Hi Chaz, I was told at the last CL meeting that ATR's are being used as full time teachers. In other words they are covering full programs without the benefit of being put on the principal's TO. The DOE is paying their full salary. If an ATR is covering a program ( even if it is out of their license ) they are still subjected to observations. I heard they are due a pre ob., but it is a scam that principals are not hiring them. They are being used and in some cases abused. I was also told that ATR's are responsible for lesson plans!

I feel that you are caught in a very bad position. I'm sorry that you have not been hired yet. When I qualified, I had to wait six years to get hired.

Once I was hired I lived in fear of being bumped by a more senior teacher.

Since you are not in the system, nothing in my comments was meant to vilify you.

It is the appearence of the midwestern two year wonders who didn't pay for their education and got a meaningless alternate certification that I am angry about.

These self proclaimed missionary types are taking positions that older teachers had, and are preferred by the shake and bake Nazi Academy administrators.


They will be out before they get tenure and are taking away jobs from people like us. They venture into the ghetto's so that, in the future ,they can regale their friends, at cocktail parties, of what it was like to be a missionary amongst the savages in the inner cities.

As the kids would say, we have been assed out.

You should really take a hard look at these blogs and ask yourself if you want to be me in twenty years.

My advice is use that brain of yours to train for something that will not degrade and debase you.

Had I had the knowledge that I have now, I would have been happier cleaning toilets for a living.

You need to look for a job outside the environs of Bloombergville.
That prick is going to stick around to make the life of the teachers much more horrendous.

Since you don't have to suffer the indignity of working for these scumbags in these sewers, you need to carefully reevaluate what you intend to do with your future.

You cannot have someone like the bald pimp making statements that they are expediting your due process. The statement is an oxymoron.

Your shitty NYSUT attorney is in on the fraud. You really need to hire a private gun in order to fight for your career.

The objective is to hatch match and dispatch.

As long as they keep going for the jugular you need to defend yourself. As it stands, it's impossible to have due process as you are being rushed on the express train to aushwitz.

How is your attorney supposed to read the paperwork for the case and devise a strategy for defense if he/she is being rushed.

The powers that be a surprised that teachers actually want a hearing to utilize proper legal procedure.
The kangaroo court was out of hand to begin with. Now it is far worse.

Down the line there will be a lot of litigation against both NYSUT and the DoE, for denial of due process rights.

Chaz, I keep suggesting to that reassigned teachers get together outside the DOE offices and talk about this as a group. Everyone keeps complaining, but it's like you are Waiting for Superman to come save you. He's not coming. The union's not coming. Nobody is coming to rescue us. ICE is not coming. They are focusing their efforts on fighting charter schools. Each of us is going to lose if we fight this alone.

I am trying to find New York City teachers who would be willing to comment for a story on tenure. I would ask questions like, how does tenure work at your school? Are there unqualified teachers who have tenure so they’ll be there forever? Or conversely, if you have tenure are you grateful for the job security? I am interested in all comments.

From the questions that you want to ask about tenure, it is very clear what kind of a slanted story you intend to write.

Tenure is not a job for life, as the talking heads and the "journalists" claim.

Tenure is only granted if you do a good job for three years. You keep your mouth shut and don't get involved with politics within the school.

Tenure is only the right to due process if your employer wants to fire you.

Given the fact that the number of teachers in the rubber rooms spiked exponentially, it proves that an end run is being done around tenure.

Senior experienced teachers have been picked to be reviled and vilified in a corrupt process that amounts to years of psychological torture and then a kafkaesque kangaroo court.

This is so the little mayor will not have to pay salaries of senior teachers.

This is classic age discrimination. Those pensions that the teachers contributed to for twenty odd years will not amount to anything more than the cost of the electricity and cable, if the city is successful in firing a teacher before they get 25 years in.

When the economy was good the press didn't wage such an evil defiling slanderous campaign against teachers.

When a teacher gets tenure a target is painted on their back.

The issue of teachers is just a smokescreen that is meant to obscure the real problems of underfunding, outsourcing, an increasingly primitive and illiterate society. The main problem is poverty.

Instead of supporting teachers you and those in your profession choose to propagandize ala Goebbels, against teachers.

You and many like you are prostituting your journalistic integrity, by selling out to the MSM. You might as well write for Pravda. Nyet?
